Spinal Injury Compensation – Provisional Damages after a Car Accident

Our solicitors helped Chris receive provisional damages of £1,000,000 after a spinal cord injury. This means he has also secured his right to return to Court to apply for further spinal injury compensation if his condition deteriorates. Chris was injured in a road traffic accident and he suffered a traumatic spinal cord injury. He went on to develop syringomyelia which is a rare condition where cyst grows within the spinal cord. Unfortunately, this increased the extent of Chris’s paralysis. Although doctors treated the syrinx successfully, there is a significant risk that is could deteriorate in the future. If this happens and Chris is not treated successfully, his paralysis will increase which will affect the level of his spinal injury compensation claim. The size of a compensation claim is affected by the level of care, equipment and property adaptations a client needs so Chris’s claim will need to increase if more of his body becomes paralysed. Rather than waiting indefinitely to conclude Chris’s case, our specialists in spinal injuries claims have helped him to secure provisional damages.

Provisional Damages give Chris Peace of Mind

Our Personal Injury solicitors worked with Chris and the medical experts to put forward his case. The High Court in London approved the settlement of Chris’s compensation claim for spinal injury. They set it at £1,000,000.00, less 30% for contributory negligence. It was very important for us to make sure that the settlement is provisional so Chris can go back to the court if his condition deteriorates due to syringomyelia. As a result, he can claim more compensation for his injuries if he becomes more paralysed in the future. This is incredibly important for Chris as it has given him peace of mind.

This is one of the first cases where the Court has awarded provisional damages for a victim of spinal cord injury. Barratts Solicitors were extremely proud to play a part in this case. Most importantly, we hope that it will set a precedent for the future so more people have peace of mind.
