CCTV Provides Vital Evidence in Compensation Claim
Jenny was walking through a busy shopping centre when she was knocked to the ground. As a result of the fall, she suffered significant shoulder injuries. She believed that she had been knocked down by a security guard who was chasing a shoplifter. We advised Jenny that if she had been knocked down by the security guard then she could claim against the insurers of his company. The security company were adamant that it was the shoplifter who knocked Jenny down. If this was true, it would only entitle her, potentially, to a much lower level of compensation through the Criminal Injuries Compensation Authority. It was important for us to find out who had caused Jenny’s injuries.
The security company produced statements from their guards who were adamant that the shoplifter had ran into Jenny. Poor quality CCTV evidence from the shopping centre was inconclusive. However, we tracked down far clearer CCTV evidence from a nearby shop. This showed the security guard colliding with Jenny and knocking her to the floor. The insurers of the security company have now admitted full liability and Jenny will receive compensation. But for the CCTV evidence obtained from the nearby shop, Jenny’s claim may well have failed.
